Platform Status: Beta All-Access ($9.99/month)

Welcome to FootsieTrolls. Please read these Terms and Conditions ("Terms", "Agreement") carefully before using the FootsieTrolls website, services, and digital media (collectively, the "Platform" or "Service"). By accessing, subscribing to, or using the Platform, you ("User", "Member", or "Digit") agree to be legally bound by these Terms. If you do not agree to all of these Terms, you are strictly prohibited from accessing or using the Service.

1. Mandatory Age Requirement & Verification

The Platform contains adult-adjacent, high-intimacy digital media, artistic nudity, and themed entertainment. Access is strictly restricted to mature audiences.

Minimum Age: You must be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction, whichever is older, to access or subscribe to the Platform.

Self-Certification Gate: By entering the Platform, you self-certify under penalty of perjury that you meet the minimum age requirement.

Payment & Age Assurance: Payment processing requires a valid credit/debit card issued in the Subscriber's name. Attempting to access the Platform as a minor, or using unauthorized payment methods, will result in immediate permanent banning and potential legal reporting.

2. Beta Phase Status & Scope of Service

FootsieTrolls is currently operating in an active development phase ("Beta Phase").

Beta Access Scope: Subscriber membership grants access to the digital "Galactic Diary" interface, featuring embedded video compilations, photo sets, written narrative logs, and interactive prompt submission features.

Flat-Rate Beta Tier: During the Beta Phase, full platform access is consolidated into a single flat-rate subscription of $9.99 per month ("Pioneer Access"). This unlocks all active content frequencies.

Evolving Platform Notice: The Platform, user interface, and upcoming interactive community chat spaces ("Phase 2") are under continuous construction. Features, media release schedules, and system layouts may be modified, updated, or temporarily suspended without prior notice as platform architecture evolves.

3. Subscriptions, Billing, and Strict No-Refund Policy

Platform access is provided on a recurring subscription basis managed through authorized third-party payment processors (e.g., Stripe).

Recurring Billing: Subscriptions automatically renew every thirty (30) days at $9.99/month unless cancelled by the user prior to the billing renewal date.

Cancellation: Subscribers may cancel auto-renewal at any time via their payment account settings or account dashboard. Cancellation stops future recurring charges but maintains access through the end of the current billing cycle.

STRICT NO-REFUND POLICY: DUE TO THE IMMEDIATE DIGITAL DELIVERY AND UNRESTRICTED ACCESS TO PROPRIETARY MEDIA AND DIGITAL CONTENT, ALL SUBSCRIPTION PURCHASES, FEES, AND CHARGES ARE STRICTLY FINAL AND NON-REFUNDABLE. NO PARTIAL REFUNDS OR CREDITS WILL BE ISSUED FOR UNUSED TIME OR CANCELLATIONS MID-CYCLE.

4. Intellectual Property & Digital Content Protection

All media hosted on or transmitted through the Platform—including videos, photographs, audio recordings, text logs, graphic artwork, branding ("STOPA-900", "FootsieTrolls", "Galactic Diary"), and software code—are the exclusive intellectual property of FootsieTrolls.

Limited License: Members are granted a limited, personal, non-exclusive, non-transferable, and revocable license to view media solely within the official Platform interface.

PROHIBITION ON DUPLICATION: DOWNLOADING, RIPPING, SCREEN RECORDING, SCREENSHOTTING, COPYING, RE-UPLOADING, DISTRIBUTING, SELLING, MODIFYING, OR REMOVING WATERMARKS FROM ANY PLATFORM MEDIA IS STRICTLY PROHIBITED.

Technical Protection & Enforcement: Media hosted on external secure streaming servers (e.g., Vimeo) is protected via domain-level security and DRM protocols. Circumventing or attempting to bypass technical protection measures constitutes a federal violation under the Digital Millennium Copyright Act (DMCA) and will result in immediate termination and aggressive civil/criminal legal enforcement.

5. Creator Safety, Privacy, and Anonymity

To protect the personal safety and privacy of creators (including flagship creator "Kit"), content production utilizes creative styling, wigs, obscured features, and scouted locations.

Identity Protection: Members ("Digits") are strictly prohibited from attempting to uncover real-world identities, legal names, personal addresses, physical locations, social media profiles, or off-platform contact information of any creator.

Zero-Tolerance Stalking/Harassment: Physical stalking, unwanted communication, doxxing, or attempting to locate creators in physical real-world environments is zero-tolerance grounds for immediate lifetime banning and law enforcement notification.

6. User Conduct & Interactive Submissions

The Platform permits members to submit prompts (such as "Truth or Dare" requests) via embedded form submission interfaces.

Content Standards: Submissions must not contain illegal, non-consensual, abusive, threatening, hate-based, or defamatory language.

License to Submissions: Submitting a prompt grants FootsieTrolls an unrestricted, worldwide, royalty-free license to adapt, respond to, incorporate, or broadcast the prompt within Platform content and lore.

Creator Discretion: Creators are under no obligation to fulfill every submitted prompt or request.

7. Account Security & Verification

Account Integrity: Members are responsible for maintaining the confidentiality of their login credentials. Account sharing or selling account access to third parties is strictly prohibited.

Registration Matching: The email address used for member account registration must match the email address associated with active payment confirmation. Unmatched or fraudulent registrations will be denied or revoked.

8. Disclaimers & Limitation of Liability

Disclaimer of Warranties: THE PLATFORM AND ALL MEDIA ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Limitation of Liability: IN NO EVENT SHALL FOOTSIETROLLS, ITS OPERATORS, CREATORS, OR DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM PLATFORM USE, TECHNICAL DISRUPTIONS, OR THIRD-PARTY HOSTING OUTAGES.

Cap on Monetary Damages: TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THIS AGREEMENT IS STRICTLY LIMITED TO THE AMOUNT PAID BY THE MEMBER IN THE SINGLE MONTH PRECEDING THE CLAIM ($9.99 USD).

9. Termination & Governing Law

FootsieTrolls reserves the right, in its sole discretion, to terminate or suspend member access immediately and without refund for breach of these Terms, unauthorized content sharing, or disruptive behavior.

These Terms shall be governed by and construed in accordance with applicable state and federal laws, without regard to conflict of law principles. If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.
